Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MollySIM website, applications, accounts, digital eSIM products, physical SIM products, mobile connectivity plans, activation services, top-ups, carrier-related products, and related customer support services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Hunke Mobile Limited, which operates the MollySIM brand ("MollySIM", "we", "us", or "our").

If you do not agree to these Terms, you must not purchase, activate, install, access, or use the Services.

If you use the Services on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

These Terms should be read together with our:

  • Refund Policy
  • Privacy Policy
  • product descriptions;
  • checkout disclosures;
  • activation instructions;
  • promotion-specific terms; and
  • any other product-specific terms displayed before or after purchase.

If product-specific terms conflict with these general Terms in relation to a particular product, the product-specific terms will apply to that product to the extent of the conflict, subject always to applicable law.

2. About MollySIM

MollySIM is operated by Hunke Mobile Limited.

MollySIM provides and resells mobile connectivity products and related services, including products supplied or operated by third-party telecommunications carriers, mobile network operators, roaming partners, wholesalers, aggregators, fulfilment providers, and other upstream service providers.

Unless expressly stated otherwise, MollySIM is not the underlying mobile network operator or telecommunications carrier providing the radio network or carrier infrastructure used by a particular SIM or eSIM.

Our role may include:

  • offering and selling connectivity products;
  • processing orders and payments;
  • arranging fulfilment;
  • delivering SIMs, eSIMs, QR codes, activation information, or top-ups;
  • providing product information;
  • providing MollySIM-level customer service; and
  • communicating with upstream suppliers where commercially reasonable.

The underlying telecommunications service may be controlled entirely or partially by a third-party carrier or supplier.

3. Eligibility

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to purchase or use the Services unless applicable law permits otherwise.

By using the Services, you represent and warrant that:

  • you have legal capacity to enter into a binding agreement;
  • the information you provide is accurate, complete, and current;
  • you will use the Services lawfully;
  • your payment method is authorized for your use;
  • you will comply with applicable telecommunications and identification requirements; and
  • where necessary, your device is unlocked and compatible with the product you purchase.

Certain countries, carriers, products, or telephone numbers may require identity verification, real-name registration, age verification, local documentation, or other regulatory procedures.

Completion of such requirements is your responsibility unless expressly stated otherwise.

4. Scope and Nature of the Services

MollySIM may offer products including, without limitation:

  • travel eSIM plans;
  • local eSIM plans;
  • regional eSIM plans;
  • global eSIM plans;
  • data-only plans;
  • voice and SMS plans;
  • physical SIM cards;
  • prepaid SIM cards;
  • carrier-issued SIM cards;
  • telephone-number products;
  • roaming products;
  • activation services;
  • top-ups and recharges;
  • carrier balances or credits;
  • vouchers and activation codes;
  • bundled connectivity products;
  • related applications and account-management tools; and
  • customer support relating to MollySIM orders.

The availability of products may differ by country, device, carrier, account, customer, or time.

We may add, remove, replace, modify, suspend, or discontinue products at any time.

Removal of a product from sale does not necessarily mean an already purchased product has been cancelled, although continued service may remain dependent on the applicable carrier or supplier.

5. Third-Party Carriers and Upstream Providers

Many MollySIM products depend on third-party telecommunications carriers, network operators, roaming partners, wholesalers, aggregators, and suppliers.

These third parties may control matters including:

  • SIM or eSIM provisioning;
  • activation;
  • network registration;
  • network access;
  • available mobile networks;
  • roaming partners;
  • network routing;
  • IP routing;
  • data speeds;
  • traffic management;
  • fair-use policies;
  • throttling;
  • hotspot or tethering availability;
  • voice services;
  • SMS services;
  • telephone numbers;
  • Wi-Fi Calling;
  • VoLTE or VoNR;
  • account eligibility;
  • number retention;
  • number recycling;
  • account verification;
  • identity verification;
  • real-name registration;
  • fraud controls;
  • security reviews;
  • roaming eligibility;
  • plan renewal;
  • top-up acceptance;
  • suspension;
  • termination; and
  • other telecommunications functionality.

MollySIM does not control the internal systems, policies, infrastructure, technical decisions, fraud controls, or commercial decisions of these third parties.

By purchasing a carrier-dependent product, you acknowledge and accept that the product relies on third-party services outside MollySIM's direct control.

6. Orders and Contract Formation

All orders are subject to acceptance by MollySIM.

Submitting an order and receiving an automated order confirmation does not necessarily mean that the order has been finally accepted or fulfilled.

We may refuse, cancel, hold, or review an order where reasonably necessary, including where:

  • a product is unavailable;
  • pricing or product information contains an error;
  • payment authorization fails;
  • payment appears suspicious;
  • fraud is suspected;
  • customer information cannot be verified;
  • additional identity verification is required;
  • a supplier cannot fulfil the order;
  • fulfilment would violate applicable law;
  • sanctions or export-control issues arise;
  • technical provisioning fails;
  • the order appears abusive; or
  • continuation of the transaction creates a material operational, security, legal, or commercial risk.

For digital products, the contract will generally be considered fulfilled when the applicable product, profile, QR code, activation code, carrier allocation, recharge, credit, or service is made available to you.

For physical products, fulfilment may begin before shipment when a SIM, number, plan, balance, or carrier resource has already been assigned specifically to your order.

7. Prices, Taxes, Billing and Payment

Prices are displayed in the currency shown at checkout unless otherwise stated.

Prices may change at any time before purchase.

The price applicable to an order is generally the price confirmed at checkout.

Depending on your location and the transaction, taxes, duties, fees, carrier charges, payment-processing charges, currency-conversion charges, or other amounts may apply.

You authorize MollySIM and its payment service providers to charge your selected payment method for the full amount shown at checkout.

Payment processing may be provided by third parties such as card processors, wallet providers, banks, or other payment services.

Exchange rates and foreign-transaction charges imposed by your bank, card issuer, or payment provider are outside MollySIM's control.

We may correct obvious pricing, currency, product, inventory, or technical errors. If an error materially affects an order that has not been fulfilled, we may cancel the order and refund the amount actually paid.

8. Digital eSIM Delivery and Activation

eSIM products are digital products.

Delivery may occur through:

  • a QR code;
  • activation code;
  • direct eSIM installation;
  • application-based installation;
  • account dashboard;
  • email;
  • carrier portal;
  • download link; or
  • another electronic delivery method.

You are responsible for ensuring that the eSIM is installed on the correct device.

Some eSIM profiles can be installed only once, cannot be transferred after installation, or cannot be reissued after deletion.

You should not delete an installed eSIM while troubleshooting unless MollySIM or the applicable carrier specifically instructs you to do so.

Deleting an eSIM may permanently prevent reinstallation or make further troubleshooting impossible.

The date on which plan validity starts varies by product. A plan may begin:

  • when the eSIM is installed;
  • when it first connects to a supported network;
  • when activated by the carrier;
  • on a specified date;
  • upon purchase;
  • upon manual activation; or
  • according to another rule disclosed on the product page.

You are responsible for reviewing the applicable activation and validity rules before purchase and use.

9. Physical SIM Products and Shipping

MollySIM may sell physical SIM cards and other physical telecommunications products.

Shipping estimates are estimates only and are not guaranteed delivery dates unless expressly stated otherwise.

Delivery may be affected by:

  • postal operators;
  • couriers;
  • customs;
  • border controls;
  • local holidays;
  • weather;
  • transport disruption;
  • local delivery restrictions;
  • incorrect addresses;
  • incomplete customer information;
  • recipient availability; or
  • other circumstances outside MollySIM's reasonable control.

You are responsible for providing a complete and accurate delivery address, recipient name, telephone number, and other requested shipping information.

If delivery fails because information supplied by you is incorrect or incomplete, additional shipping or handling charges may apply.

Import duties, customs charges, local taxes, or similar amounts imposed by authorities or delivery providers are your responsibility unless checkout expressly states otherwise.

Once a physical SIM has been shipped, activated, registered, opened, assigned, or used, refund rights may be restricted in accordance with our Refund Policy and applicable law.

10. Device Compatibility

You are responsible for verifying device compatibility before purchase.

Not all devices support:

  • eSIM;
  • every eSIM implementation;
  • every physical SIM format;
  • required frequency bands;
  • 4G/LTE;
  • 5G;
  • VoLTE;
  • VoNR;
  • Wi-Fi Calling;
  • hotspot or tethering;
  • dual-SIM operation;
  • roaming;
  • particular APN configurations; or
  • particular carrier profiles.

A device may also be restricted by:

  • carrier locking;
  • regional firmware;
  • manufacturer restrictions;
  • operating-system restrictions;
  • local regulations;
  • enterprise-management policies;
  • SIM limitations; or
  • network certification requirements.

Compatibility information provided by MollySIM is intended as guidance and may not cover every device model, regional variant, software version, or carrier configuration.

Unless expressly stated otherwise, MollySIM does not guarantee that a particular device will support every feature of a particular product.

11. Plan Details, Validity and Usage Rules

Each product may contain its own conditions, including:

  • supported countries and regions;
  • supported carriers;
  • activation window;
  • validity period;
  • data allowance;
  • daily allowance;
  • total allowance;
  • high-speed allowance;
  • fair-use threshold;
  • post-threshold speed;
  • hotspot rules;
  • voice allowance;
  • SMS allowance;
  • telephone-number availability;
  • roaming eligibility;
  • recharge eligibility;
  • renewal rules;
  • network-generation availability;
  • carrier routing; and
  • other product-specific restrictions.

You are responsible for reviewing the product page and checkout information before purchase.

Data usage measured by the applicable carrier, supplier, or network platform will generally be used to determine consumption and remaining balance.

Carrier accounting systems may not update in real time.

Usage displayed on your device may differ from usage recorded by the carrier because of measurement methods, background traffic, rounding, delayed reporting, or network-level overhead.

12. Network Availability, Coverage and Performance

Mobile telecommunications services are inherently dependent on external network conditions.

Coverage maps, network names, speed descriptions, technology labels such as "4G" or "5G", and performance estimates are provided for general reference unless expressly guaranteed in writing.

Actual service may vary because of:

  • your location;
  • terrain;
  • buildings;
  • indoor signal conditions;
  • network congestion;
  • carrier maintenance;
  • network outages;
  • roaming restrictions;
  • spectrum availability;
  • device capabilities;
  • local regulation;
  • carrier prioritization;
  • fair-use policies;
  • traffic management;
  • upstream routing; or
  • other network conditions.

MollySIM does not guarantee:

  • uninterrupted connectivity;
  • continuous network availability;
  • a minimum network speed unless explicitly stated;
  • continuous 5G availability;
  • access to a particular local carrier;
  • a particular latency;
  • a particular routing path;
  • a particular roaming partner;
  • performance in every indoor location;
  • performance in remote areas; or
  • uninterrupted availability throughout the validity period.

The carrier or roaming partner available to a product may change without notice.

13. Fair Use, Throttling and Speed Policies

Certain products are subject to fair-use policies, traffic-management policies, daily high-speed allowances, total high-speed allowances, or speed restrictions.

Where a product states that speed will be reduced after a particular usage threshold, the reduced speed is part of the product's service specification and is not a service defect.

Actual speeds may nevertheless vary below any advertised maximum or post-threshold reference speed because of network conditions outside MollySIM's control.

Carrier systems determine usage counters, network prioritization, throttling, resets, and fair-use enforcement.

Unless explicitly guaranteed in writing, descriptions such as "5G", "high speed", "premium", "unlimited", "fast", or similar terms do not guarantee a constant speed at all times or locations.

Any specific fair-use rule displayed on the product page forms part of the terms of that product.

14. Network Routing, IP Addresses and Geolocation

Mobile data provided through travel SIM and eSIM products may be routed through networks or gateways located outside the country in which you are physically located.

As a result:

  • your public IP address may appear to be located in another country or region;
  • internet latency may differ from local SIM service;
  • some websites or applications may display different regional content;
  • certain services may perform additional verification;
  • geolocation databases may identify your location incorrectly; and
  • routing may change during the life of a plan.

Unless expressly stated on the product page, MollySIM does not guarantee:

  • a local IP address;
  • an IP address from a particular country;
  • a dedicated IP address;
  • a static IP address;
  • residential IP classification;
  • unrestricted access to geographically restricted content;
  • compatibility with VPN services;
  • bypass of internet filtering or censorship; or
  • acceptance by any particular website, platform, financial service, streaming service, or application.

15. Carrier Policy, Network and Service Changes

Telecommunications carriers, roaming partners, suppliers, regulators, and other third parties may change their policies, systems, coverage, networks, services, eligibility requirements, or commercial arrangements at any time.

Such changes may include, without limitation:

  • roaming policy changes;
  • roaming-network changes;
  • coverage changes;
  • supported-network changes;
  • network shutdowns or migrations;
  • fair-use policy changes;
  • speed-policy changes;
  • hotspot restrictions;
  • voice or SMS changes;
  • Wi-Fi Calling changes;
  • VoLTE or VoNR changes;
  • number-management changes;
  • number-recycling policies;
  • account requirements;
  • real-name-registration requirements;
  • identity-verification requirements;
  • activation requirements;
  • recharge or renewal rules;
  • fraud-control procedures;
  • security reviews;
  • service suspension;
  • termination;
  • geographic restrictions;
  • regulatory restrictions; or
  • discontinuation of a product or service.

If a product conformed to its applicable description when sold or fulfilled, and a later limitation, suspension, modification, or loss of functionality results from a carrier, roaming partner, supplier, government authority, regulator, or other third party outside MollySIM's reasonable control, that change does not by itself constitute a MollySIM product defect or failure to perform.

Except where required by applicable law or where the issue results from an error attributable to MollySIM, carrier or third-party policy changes are generally not grounds for a refund, replacement, compensation, reimbursement, or damages.

MollySIM cannot guarantee that:

  • a carrier will continue supporting a product;
  • a particular roaming relationship will continue;
  • a telephone number will remain eligible for a particular service;
  • a carrier will maintain the same account policy;
  • a specific feature will remain available;
  • an existing network route will remain unchanged; or
  • a carrier's policies will remain the same after your purchase.

By purchasing a telecommunications product, you acknowledge that third-party carrier services and policies may change during or after the product's validity period.

16. Voice, SMS, Telephone Numbers and Wi-Fi Calling

Some products may include:

  • voice calls;
  • SMS;
  • telephone numbers;
  • incoming calls;
  • outgoing calls;
  • incoming SMS;
  • outgoing SMS;
  • Wi-Fi Calling;
  • voicemail;
  • caller ID;
  • roaming voice; or
  • pay-as-you-go balances.

These features are available only where expressly stated.

Availability may depend on the carrier, destination, roaming network, device, network configuration, account status, and applicable law.

Unless expressly stated otherwise, MollySIM does not guarantee:

  • Wi-Fi Calling availability;
  • Wi-Fi Calling activation from a particular country;
  • VoLTE availability;
  • SMS delivery from every sender;
  • successful outgoing SMS to every destination;
  • successful incoming calls from every carrier;
  • caller-ID presentation;
  • voicemail availability;
  • number portability;
  • permanent retention of a telephone number; or
  • support for emergency calling.

Customers should not rely on MollySIM travel connectivity products as their sole means of contacting emergency services.

17. Third-Party Verification, OTPs, Banking and Platform Compatibility

Customers may choose to use a SIM, eSIM, or telephone number for:

  • account registration;
  • one-time passwords;
  • two-factor authentication;
  • banking;
  • financial services;
  • cryptocurrency exchanges;
  • payment applications;
  • social-media platforms;
  • messaging applications;
  • government services;
  • online marketplaces; or
  • other third-party services.

MollySIM does not control these third parties.

Unless MollySIM expressly guarantees a particular use case in writing, we do not guarantee that any third-party website, bank, application, exchange, social network, payment service, government service, or platform will:

  • accept a particular telephone number;
  • recognize a particular carrier;
  • send an OTP;
  • deliver an SMS;
  • deliver a voice call;
  • permit registration;
  • permit account recovery;
  • accept a recycled number;
  • accept a roaming number;
  • accept a virtual or prepaid number; or
  • continue supporting that number in the future.

A third party's refusal, blocking, filtering, or failure to send a message does not by itself mean the SIM, eSIM, or telephone number is defective.

Third-party verification compatibility is generally not grounds for a refund unless a specific compatibility guarantee was expressly included in the product description or applicable law requires otherwise.

18. Customer Support and Scope of Technical Assistance

For MollySIM orders, the MollySIM official customer-support channels are the primary point of contact for order-related after-sales service.

Support requests should be submitted through our official Contact Us channels.

MollySIM may provide assistance with matters within our reasonable control, including:

  • order status;
  • payment status;
  • fulfilment status;
  • SIM or eSIM delivery;
  • basic installation instructions;
  • basic activation guidance;
  • product information;
  • plan details;
  • MollySIM account issues;
  • order corrections where available; and
  • determining whether a problem appears to originate from MollySIM, a supplier, a carrier, or the customer's device.

18.2 Carrier-Level Issues

MollySIM does not operate or control third-party carrier networks and therefore cannot provide carrier-internal technical support.

Where an issue is reasonably determined to arise from:

  • carrier policy;
  • carrier account management;
  • carrier fraud controls;
  • carrier security review;
  • roaming restrictions;
  • network infrastructure;
  • carrier provisioning systems;
  • carrier identity verification;
  • carrier account suspension;
  • number restrictions;
  • carrier service termination;
  • regulatory restrictions; or
  • other systems controlled by a telecommunications carrier or third party,

MollySIM may be unable to investigate or resolve the underlying issue.

In those circumstances, MollySIM may direct you to the applicable carrier, supplier, or other third party.

MollySIM is not obligated to:

  • contact a carrier on your behalf;
  • negotiate with a carrier;
  • appeal carrier decisions;
  • request removal of a carrier restriction;
  • restore a carrier account;
  • override a carrier fraud decision;
  • modify a carrier's policy;
  • obtain confidential carrier records; or
  • guarantee that a carrier will resolve the issue.

Any additional assistance MollySIM voluntarily provides in such circumstances is provided as a customer-service courtesy and does not constitute an admission of liability or a guarantee of resolution.

18.3 Support Availability

Support hours, supported languages, response times, and communication channels may vary.

Any stated response time is a target rather than a guaranteed resolution time unless expressly stated otherwise.

19. Troubleshooting and Customer Cooperation

Where MollySIM agrees to investigate a connectivity or activation problem, we may request reasonable diagnostic information, including:

  • order number;
  • device model;
  • operating-system version;
  • location;
  • screenshots;
  • eSIM status;
  • SIM status;
  • network selection;
  • APN settings;
  • roaming settings;
  • error messages;
  • carrier name;
  • signal status;
  • activation time;
  • usage information; or
  • other relevant diagnostic information.

We may also ask you to perform reasonable troubleshooting steps.

You must not intentionally provide false, manipulated, misleading, or incomplete troubleshooting information.

Failure to cooperate with reasonable troubleshooting may limit our ability to determine whether a product is defective and may affect refund eligibility under our Refund Policy.

20. Customer Responsibilities

You are responsible for:

  • reading the product description before purchase;
  • choosing the correct destination;
  • choosing the correct product;
  • checking validity and activation rules;
  • checking whether voice or SMS is included;
  • checking whether a telephone number is included;
  • checking whether roaming is included;
  • checking fair-use and speed policies;
  • checking device compatibility;
  • ensuring your device is carrier-unlocked;
  • entering accurate order information;
  • entering accurate shipping information;
  • following installation instructions;
  • complying with local registration requirements;
  • maintaining adequate device security;
  • preserving SIM and eSIM credentials;
  • contacting support before deleting an eSIM where troubleshooting is required; and
  • using the Services lawfully.

Failure to meet these responsibilities may result in service limitations and may affect refund eligibility.

21. Acceptable Use and Prohibited Conduct

You must not misuse the Services.

Prohibited activities include, without limitation:

  • illegal activity;
  • fraud;
  • payment fraud;
  • identity fraud;
  • harassment;
  • spam;
  • bulk unsolicited messaging;
  • malicious software distribution;
  • unauthorized interception;
  • network attacks;
  • unlawful surveillance;
  • infringement of third-party rights;
  • bypassing technical restrictions in violation of law or contract;
  • unauthorized resale;
  • unauthorized redistribution;
  • abuse of promotions;
  • manipulation of referral programs;
  • creation of multiple accounts to obtain benefits improperly;
  • artificially generated usage;
  • SIM-box activity where prohibited;
  • automated or excessive use inconsistent with the applicable product;
  • activities that harm or overload carrier networks;
  • falsifying support evidence;
  • making knowingly false refund claims; or
  • using stolen or unauthorized payment instruments.

MollySIM and its suppliers may monitor usage information to the extent permitted by law for fraud prevention, security, billing, network management, and compliance purposes.

22. Fraud, Payment Disputes and Chargebacks

If you believe there is a problem with an order, you should contact MollySIM before opening a payment dispute where reasonably possible.

If a chargeback, payment dispute, or payment reversal is opened, MollySIM may provide relevant transaction evidence to:

  • payment processors;
  • card networks;
  • banks;
  • wallet providers;
  • fraud-prevention providers; or
  • dispute-resolution platforms.

Such evidence may include, where applicable:

  • order records;
  • checkout records;
  • payment records;
  • account records;
  • delivery records;
  • email-delivery records;
  • QR-code delivery records;
  • eSIM access records;
  • activation records;
  • usage records;
  • carrier records;
  • supplier records;
  • shipping records;
  • IP logs;
  • device information;
  • support communications;
  • screenshots; and
  • records showing acceptance of these Terms and our Refund Policy.

Fraudulent, abusive, or knowingly false disputes may result in:

  • account suspension;
  • cancellation of pending orders;
  • refusal of future transactions;
  • withdrawal of promotional benefits; or
  • other lawful protective measures.

Nothing in this section limits your lawful right to dispute unauthorized or genuinely incorrect charges.

23. Refunds, Cancellations, Replacements and Store Credit

Refunds and cancellations are governed by our Refund Policy, which is incorporated into these Terms by reference.

Many MollySIM products are digital, carrier-issued, time-sensitive, customized, immediately usable, or irreversible once delivered, assigned, installed, activated, redeemed, recharged, shipped, or used.

As a result, refund eligibility may depend on:

  • product type;
  • fulfilment status;
  • delivery status;
  • activation status;
  • installation status;
  • usage;
  • shipping status;
  • supplier records;
  • carrier records; and
  • the reason for the request.

Submitting a refund request does not guarantee approval.

Where appropriate, MollySIM may offer:

  • replacement;
  • alternative service;
  • alternative plan;
  • store credit;
  • partial refund;
  • reshipment; or
  • another commercially reasonable resolution.

Nothing in these Terms or the Refund Policy excludes any consumer right that cannot lawfully be excluded.

24. Promotions, Coupons, Referral Credits and Rewards

Promotions, coupons, discounts, referral credits, affiliate rewards, store credits, and other incentives may be subject to additional rules.

Unless expressly stated otherwise:

  • promotions may expire;
  • promotions may be limited to selected products;
  • multiple promotions may not be combined;
  • coupons have no cash value;
  • store credits have no cash value;
  • referral credits are non-transferable;
  • promotional balances cannot be withdrawn as cash; and
  • promotions may be revoked in cases of error, fraud, abuse, or violation of applicable rules.

Referral and Affiliate Programs

MollySIM may operate customer-referral and business-affiliate programs.

Self-referrals, artificial referrals, duplicate-account abuse, false identities, manipulated transactions, spam, deceptive advertising, and other attempts to obtain rewards improperly are prohibited.

Unless the applicable promotion states otherwise, customer referral credits may only be used toward eligible MollySIM purchases and may be subject to a maximum percentage of an order value.

We may withhold, reverse, cancel, or invalidate rewards associated with:

  • refunded orders;
  • fraudulent orders;
  • chargebacks;
  • self-referrals;
  • duplicate accounts;
  • cancelled transactions; or
  • violations of program rules.

25. Accounts and Account Security

Certain Services may require a MollySIM account.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • protecting access to your email account;
  • keeping account information current; and
  • all activity performed through your account unless caused by a security failure attributable to MollySIM.

You must notify MollySIM promptly if you reasonably suspect unauthorized access to your account.

We may require additional verification before allowing sensitive account actions.

We may restrict accounts that appear:

  • compromised;
  • fraudulent;
  • abusive;
  • duplicated for promotional abuse; or
  • otherwise inconsistent with these Terms.

26. Third-Party Services

The Services may use, integrate with, or link to third-party services including:

  • telecommunications carriers;
  • roaming partners;
  • payment processors;
  • banks;
  • fraud-prevention providers;
  • analytics services;
  • application stores;
  • delivery companies;
  • identity-verification providers;
  • cloud infrastructure;
  • messaging services; and
  • external websites.

These third parties may have their own terms and privacy policies.

MollySIM is not responsible for the independent acts, omissions, content, availability, or policies of third parties except to the extent responsibility cannot lawfully be excluded.

27. Suspension and Termination

MollySIM may suspend, restrict, cancel, or terminate access to some or all Services where reasonably necessary, including where:

  • you breach these Terms;
  • fraudulent activity is suspected;
  • payment fraud is suspected;
  • a charge is reversed after fulfilment;
  • illegal activity is suspected;
  • there is a material security risk;
  • you abuse a carrier or supplier network;
  • identity verification fails;
  • a carrier suspends service;
  • a carrier or supplier discontinues support;
  • a regulator requires suspension;
  • continuing to provide service becomes illegal;
  • continuing to provide service becomes technically impossible; or
  • continuation creates a material risk to MollySIM, its customers, suppliers, or partners.

Where a suspension or termination occurs because of circumstances attributable to MollySIM, refund rights will be assessed under the Refund Policy and applicable law.

Where suspension or termination is caused by the customer's breach, abuse, fraud, carrier action, regulatory action, or another factor outside MollySIM's reasonable control, refunds may not be available.

Sections that by their nature should survive termination will remain in effect, including provisions relating to:

  • payment obligations;
  • intellectual property;
  • disclaimers;
  • limitations of liability;
  • indemnification;
  • disputes; and
  • governing law.

28. Intellectual Property

The Services and their underlying content, including:

  • software;
  • source material;
  • text;
  • graphics;
  • logos;
  • icons;
  • images;
  • design;
  • branding;
  • trademarks;
  • databases;
  • product compilations;
  • documentation; and
  • related intellectual property

are owned by MollySIM, Hunke Mobile Limited, or their licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, MollySIM grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for lawful personal purposes.

Unless permitted by law or authorized in writing, you may not:

  • copy;
  • reproduce;
  • redistribute;
  • resell;
  • scrape;
  • reverse engineer;
  • modify;
  • create derivative works from;
  • frame;
  • extract substantial portions of; or
  • commercially exploit

the Services or MollySIM content.

29. User Content and Feedback

If you submit reviews, comments, testimonials, suggestions, support messages, photographs, screenshots, feedback, or other content to MollySIM, you represent that you have the right to provide that content.

Where you intentionally submit material for publication, promotion, review, or feedback purposes, you grant MollySIM a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, distribute, and display that content for purposes reasonably related to:

  • operating the Services;
  • customer support;
  • improving products;
  • fraud prevention;
  • resolving disputes; or
  • marketing MollySIM,

subject to applicable law and our Privacy Policy.

Support communications containing personal or diagnostic information will be handled according to our Privacy Policy and applicable law.

30. Privacy and Personal Data

Your use of MollySIM is subject to our Privacy Policy.

MollySIM may process information necessary to provide the Services, including information relating to:

  • accounts;
  • purchases;
  • payments;
  • devices;
  • network usage;
  • activations;
  • support requests;
  • fraud prevention;
  • security; and
  • compliance.

Certain carrier products may also require personal data to be provided to carriers, registration systems, identity-verification providers, or government-mandated systems.

Where applicable, such processing may also be governed by the relevant third party's privacy policy and legal obligations.

31. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

Except for any guarantee that cannot lawfully be excluded, MollySIM disclaims all express, implied, statutory, and other warranties, including warranties of:

  • merchantability;
  • satisfactory quality;
  • fitness for a particular purpose;
  • title;
  • non-infringement;
  • continuous availability; and
  • compatibility with every device, network, application, platform, destination, or intended use.

MollySIM does not guarantee that the Services will:

  • always be available;
  • be error-free;
  • be uninterrupted;
  • be completely secure;
  • operate on every device;
  • operate on every network;
  • meet every customer's intended use;
  • maintain a particular carrier;
  • maintain a particular telephone number;
  • maintain a particular routing configuration; or
  • remain unaffected by future carrier or regulatory changes.

Nothing in this section excludes liability or consumer rights that cannot legally be excluded.

32. Limitation of Liability

To the maximum extent permitted by applicable law, MollySIM, Hunke Mobile Limited, and their affiliates, officers, directors, employees, contractors, licensors, suppliers, carriers, and partners will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to the Services.

This includes, without limitation, loss of:

  • profits;
  • revenue;
  • business opportunity;
  • anticipated savings;
  • goodwill;
  • data;
  • communications;
  • account access;
  • third-party platform access; or
  • business continuity.

MollySIM is not responsible for losses caused by reliance on a SIM, eSIM, or telephone number for a critical third-party service where MollySIM did not expressly guarantee that use case.

Examples include loss resulting from:

  • failure to receive an OTP;
  • inability to access a bank;
  • inability to access an exchange;
  • inability to access a social-media account;
  • failure of a third-party verification system;
  • a carrier suspending a telephone number;
  • a third party refusing a number; or
  • inability to use a telecommunications product for emergency communications.

To the maximum extent permitted by law, MollySIM's aggregate liability arising out of or relating to a particular product or Service will not exceed the greater of:

  • the amount you paid MollySIM for the specific product or Service giving rise to the claim during the three months immediately preceding the event giving rise to liability; or
  • USD 100.

The limitations in this section do not apply to liability that cannot lawfully be excluded or limited.

Nothing in these Terms limits any mandatory statutory consumer right.

33. Events Outside Our Reasonable Control

MollySIM will not be responsible for failure or delay caused by events outside our reasonable control.

These may include:

  • carrier outages;
  • network failures;
  • supplier failures;
  • internet outages;
  • roaming-partner changes;
  • submarine-cable failures;
  • power failures;
  • natural disasters;
  • severe weather;
  • war;
  • civil unrest;
  • terrorism;
  • government action;
  • sanctions;
  • regulatory changes;
  • telecommunications restrictions;
  • border closures;
  • strikes;
  • transport disruption;
  • cyberattacks;
  • large-scale infrastructure failures;
  • failures of payment networks;
  • failures of cloud providers; or
  • other force-majeure events.

This section does not remove rights that cannot lawfully be excluded.

34. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless MollySIM, Hunke Mobile Limited, and their affiliates, officers, directors, employees, contractors, licensors, suppliers, and partners from claims, liabilities, damages, judgments, losses, costs, and reasonable legal expenses arising from:

  • your unlawful use of the Services;
  • your material breach of these Terms;
  • fraud committed by you;
  • your infringement of third-party rights;
  • your unauthorized resale or redistribution of Services; or
  • content submitted by you that violates applicable law or third-party rights.

This provision does not require a consumer to indemnify MollySIM for MollySIM's own negligence, breach, misconduct, or other liability where such an indemnity would be prohibited by law.

35. Export Controls, Sanctions and Legal Restrictions

You must not use the Services in violation of:

  • export-control laws;
  • trade sanctions;
  • telecommunications laws;
  • anti-money-laundering requirements;
  • anti-fraud laws;
  • anti-boycott laws; or
  • other applicable legal restrictions.

MollySIM may refuse or terminate service where legally required or where a transaction creates a material sanctions, compliance, or regulatory risk.

Product availability displayed on the website does not constitute a representation that use of that product is lawful in every jurisdiction.

You are responsible for complying with laws applicable to your own use of the Services.

36. Communications

You agree that MollySIM may send you electronic communications relating to:

  • orders;
  • payments;
  • account security;
  • activations;
  • service changes;
  • support requests;
  • refunds;
  • carrier changes;
  • policy updates;
  • legal notices; and
  • other operational matters.

You are responsible for maintaining accurate contact information.

Marketing communications are subject to applicable law and your communication preferences.

You may unsubscribe from marketing messages using the available unsubscribe mechanism, but necessary transactional, security, legal, and service communications may still be sent.

37. Changes to Products and Services

MollySIM may modify:

  • product availability;
  • suppliers;
  • carriers;
  • pricing;
  • plan configurations;
  • applications;
  • features;
  • fulfilment methods;
  • payment methods; or
  • other aspects of the Services.

Where a modification affects an existing purchase, your rights will depend on:

  • the product-specific terms;
  • whether the product has already been fulfilled;
  • the reason for the change;
  • whether the change is attributable to MollySIM or a third party; and
  • applicable law.

Nothing in this section permits MollySIM to avoid obligations that cannot lawfully be excluded.

38. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date.

Where required by applicable law, we will provide additional notice of material changes.

Changes generally apply prospectively from their effective date.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

The Terms in effect when an order was placed may remain relevant to rights or obligations arising from that order where required by applicable law.

39. Governing Law

These Terms and any non-contractual obligations arising out of or relating to them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country or place of habitual residence and that cannot lawfully be waived by contract.

40. Dispute Resolution and Jurisdiction

If you have a dispute relating to MollySIM, you are encouraged to contact us first through our official Contact Us channels so that we can attempt to resolve the matter informally.

Please provide:

  • your order number;
  • account email;
  • description of the issue; and
  • relevant supporting information.

If a dispute cannot be resolved informally, the courts of the Hong Kong Special Administrative Region will have jurisdiction, subject to any mandatory consumer-law rights you may have to bring proceedings in another jurisdiction.

Nothing in this section prevents either party from seeking urgent or interim relief where legally available.

41. Mandatory Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or modify a right, remedy, guarantee, condition, warranty, obligation, or liability where doing so would be unlawful.

If applicable consumer law grants you mandatory rights that conflict with a provision of these Terms, those mandatory rights will prevail to the extent of the conflict.

References in these Terms to exclusions, limitations, non-refundability, or disclaimers are therefore subject to applicable law.

42. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally possible.

The remaining provisions will continue in full force and effect.

43. No Waiver

If MollySIM does not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

A waiver is effective only where made expressly by an authorized representative and only for the specific matter to which it relates.

44. Assignment

You may not assign or transfer your rights or obligations under these Terms without MollySIM's prior written consent.

MollySIM may assign or transfer its rights or obligations in connection with:

  • a merger;
  • acquisition;
  • corporate restructuring;
  • financing;
  • sale of assets;
  • transfer of business operations; or
  • transfer to an affiliate or successor,

subject to applicable law.

45. Entire Agreement

These Terms, together with:

  • the Refund Policy;
  • the Privacy Policy;
  • applicable product descriptions;
  • checkout disclosures;
  • promotion-specific terms; and
  • other product-specific terms

constitute the agreement between you and MollySIM relating to the applicable Services.

They supersede prior representations relating to the same subject matter, except where applicable law provides otherwise.

46. Language

These Terms may be made available in multiple languages.

Translations are provided for convenience.

Unless prohibited by applicable law, if there is an inconsistency between the English version and a translated version, the English version will prevail.

This provision does not limit any mandatory rights relating to language or consumer disclosures under applicable law.
